EPA's Transport Rule (CSAPR) Vacated

August 21, 2012 - The U.S. Court of Appeals has vacated the EPA's cross state air pollution rule (CSAPR) along with the associated federal implementation plans (FIPs). As a result, the EPA is required to continue with its implementation of CAIR until a valid replacement rule can be promulgated. In its judgment, the U.S. Court of Appeals determined that the CSAPR was fundamentally flawed and that the EPA overstepped its jurisdictional limits in issuing FIPs without giving the affected States an opportunity to submit state implementation plans (SIPs).
